Lawsuit Against Carbon Health & Employee for Systemic Sexual Assault of Patients
The law firms of Hoffman Sternberg, Karpf & Lynch and Stampone O’Brien Dilsheimer Holloway are jointly representing a victim of a brutal sexual assault committed by a Carbon Health employee who fraudulently posed as a nurse. Today, they announce the filing of a civil lawsuit in Philadelphia against Carbon Health, its employee Ramon Garcia, and others, to hold them accountable for the repeated sexual assaults of their patients.
On Monday, March 24, 2025, Ramon Garcia will plead guilty to a new criminal count of aggravated sexual assault against our client. He will then be sentenced for his crimes, including those committed against other patients he victimized while employed at Carbon Health Urgent Care. Criminal Sentencing and a Sexual Violent Predator hearing will take place at 2pm before The Honorable Wendy Rothstein at the Montgomery County Court of Common Pleas.
“Victims of the Carbon Health sexual assaults have rights and protections under the law,” said Robert T. Lynch, attorney at Hoffman, Sternberg, Karpf & Lynch. “We are seeking to hold Carbon Health fully accountable for what we believe was a systemic pattern of sexual assaults against their own patients.”
The lawsuit alleges that Carbon Health failed to properly supervise, train, and staff their facilities, creating an environment where a sexual predator was able to fraudulently pose as a nurse and repeatedly prey on female patients. The suit further claims that patients, in a
vulnerable state, were subjected to sexual abuse under the guise of medical exams, improper viewing during states of undress, and the collection of unnecessary biological samples. In some instances, it is alleged that photographs or videos were taken surreptitiously. Investigation has so far unveiled at least 18 victims from evidence gathered, but not all victims have come forward yet.
“We believe that legal action through civil lawsuits is the best way for victims to have a voice, fight back, and seek justice while shining a spotlight on this deeply troubling issue,” said Kevin O’Brien, attorney at Stampone O’Brien Dilsheimer Holloway.
We urge any other Carbon Health patients who believe they were victims of sexual assault, improper medical exams, or unauthorized photographing or recording to come forward.
